Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and PuzzleBam Ltd ("PuzzleBam", "we", "us", or "our") regarding your use of the NERD WORDS mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years old to use NERD WORDS. By using the App, you represent and warrant that you are at least 13 years of age. If you are under 18, you represent that you have your parent's or guardian's permission to use the App.

3. Account and Authentication

To access certain features of the App, including online multiplayer, you must sign in using Sign in with Apple (iOS) or Google Sign-In (Android). You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

Some features of the App, including Pass and Play, vs Bot, and Solo modes, may be used without signing in, subject to feature availability and purchases.

4. In-App Purchases

PuzzleBam Ltd offers optional in-app purchases within NERD WORDS, including additional active game slots, single player mode access, ad removal, and bundled packages. All purchases are one-time, non-consumable, and processed through Apple App Store or Google Play Store.

Prices are displayed in your local currency at the time of purchase. All sales are final. Refunds are handled according to Apple's and Google's respective refund policies. PuzzleBam does not directly process payments or handle refund requests.

Purchases are linked to your Apple ID or Google account and can be restored if you reinstall the App or switch devices within the same platform.

5. Game Rules and Fair Play

NERD WORDS is a word game intended for fair competition between players. By using the App, you agree to play fairly and abide by the game rules.

5.1 Abandoned Games

If you do not make a move in an active online game for 30 consecutive days, your opponent may end the game. If your opponent has a higher score, they will be awarded the win. If you have a higher score or the scores are tied, the game will end with no winner.

6. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Using cheats, hacks, or external tools to gain an unfair advantage
• Exploiting bugs or vulnerabilities in the App
• Using offensive, inappropriate, or misleading usernames
• Harassing, threatening, or abusing other players
• Impersonating other players or PuzzleBam staff
• Spamming or sending excessive messages
• Creating multiple accounts to circumvent rules or manipulate the system
• Creating new accounts to circumvent bans or suspensions
• Intentionally losing games or engaging in match fixing
• Boosting, win trading, or colluding with other players to manipulate rankings
• Using bots, scripts, or automated tools to play the game
• Selling, trading, purchasing, or sharing accounts
• Making fraudulent purchases or initiating chargebacks
• Filing false reports against other players
• Reverse engineering, decompiling, or data scraping the App
• Interfering with servers, networks, or other players' connections
• Attempting to scam, phish, or exploit other players
• Using the App for commercial purposes without authorisation

7. Enforcement and Penalties

PuzzleBam reserves the right to investigate and take appropriate action against anyone who violates these Terms, including:

• Issuing warnings for minor or first-time offences
• Temporary suspension (typically 7 days) for repeated minor offences
• Permanent account termination for serious offences such as cheating or harassment
• Immediate permanent termination for severe offences such as hacking or fraud

If your account is terminated, you will lose access to all gameplay data, statistics, and active games. In-app purchases cannot be refunded for accounts terminated due to Terms violations.

7.1 Appeals

If you believe your account was suspended or terminated in error, you may appeal by emailing support@playnerdwords.com. Appeals will be reviewed at PuzzleBam's sole discretion, and decisions are final.

8. Intellectual Property

The App and all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, and software) are owned by PuzzleBam Ltd and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

9. User Content and Communication

You may set a custom display name and upload a profile photo. Display names must not be offensive, inappropriate, or misleading. Profile photos are moderated using automated image analysis and must comply with our content guidelines. PuzzleBam reserves the right to remove or reset any display name or profile photo that violates these guidelines.

The App provides pre-set quick messages for communication between players during games. Custom messaging between players is not supported.

You may report other players for violations using the in-app report function. False or abusive reports may result in penalties against your account.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. PUZZLEBAM DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

PUZZLEBAM DOES NOT GUARANTEE ANY SPECIFIC RESULTS FROM USE OF THE APP, INCLUDING MATCHMAKING, RANKINGS, OR GAME OUTCOMES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUZZLEBAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

IN NO EVENT SHALL PUZZLEBAM'S TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO PUZZLEBAM FOR IN-APP PURCHASES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Modifications to the App and Terms

PuzzleBam reserves the right to modify, suspend, or discontinue the App (in whole or in part) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App. Your continued use of the App after such changes constitutes acceptance of the new Terms.

13. App Updates

From time to time, we may release updates to the App. You may be required to install updates to continue using the App. Failure to install required updates may result in inability to access game features, including online multiplayer.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where prohibited by your local consumer protection laws.

Nothing in these Terms shall limit your statutory rights as a consumer under the laws of your country of residence.

15. Termination

You may stop using the App at any time. You may also delete your account through the App's Settings menu, which will permanently delete all your data.

PuzzleBam may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, and limitations of liability.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PuzzleBam regarding your use of the App and supersede all prior agreements and understandings.
